During the first few decades of the twentieth century, legal theory on both sides of the Atlantic was characterized by a tremendous amount of skepticism toward the private law concepts of property and contract. In the United States and France, Oliver Wendell Holmes and François Gény led the charge with withering critiques of the abuse of deduction, exposing their forebears' supposedly gapless system of private law rules for what it was, a house of cards built on the ideological foundations of (...) laissez faire capitalism. The goal was to make the United States Constitution and the French civil code more responsive to the realities of industrialization. Unlike the other participants in this transatlantic critique, François Gény simultaneously insisted on the immutability of justice and social utility. His “ineluctable minimum of natural law” would guide judges and jurists toward the proper social ends, replacing deduction with teleology. The problem was that nearly all of Gény's contemporaries were perplexed by his conception of natural law, which lacked the substance of the natural rights tradition of the eighteenth and nineteenth centuries and the historicist impulse of the early twentieth. No one was more perplexed than Oliver Wendell Holmes, whose more thorough going skepticism led him to see judicial restraint as the only solution to the abuse of deduction. The ultimate framework for this debate was World War I, in which both Holmes and Gény thought they had found vindication for their views. Events on the battlefield reaffirmed Gény's commitment to justice just as they reignited Holmes' existential embrace of the unknown. In a sense, the limits of their skepticism would be forged in the trenches of the Great War. (shrink)

The percentage of female entrepreneurs is far below the level of males, although it has increased over the past several years. Based on the theory of planned behavior, the purpose of this article is to specify a model in which the relationship among entrepreneurial potential, gender and entrepreneurial intention are explored, by analyzing how perceived behavioral control (PBC) and perceived entrepreneurial skills, as exogenous variables, affect expression of intention for business, and how these are mediated by their entrepreneurial motivations and (...) risk taking propensity. Control variables where also included in this model, such as necessity-driven motives for business, in order to observe whether these are an influential factor. An implementation of Structural Equation Modeling (SEM) was used to analyze data collected from 677 students. Variables within the model were compared by gender using t-Test, and all multivariate analysis were done by each one separately as well in order to better gauge their perceptions. Results showed that mean differences between males and females are not abundant, and come only from intentions, PBC and subjective norm, which are higher in males; and motives for business higher in females. Multivariate analysis shows gender differences at the mediation level and that necessity-driven motives are an influencing factor, more so in males, and it hampers the significance of subjective norm. Finally, the theoretical and practical implications of the results within the framework of entrepreneurship in Spain and future alternatives to improve the entrepreneurial potential are discussed. The traditional emphasis on the physics of the very small is questioned, and the suggestion made that a crucial test of contributions to the philosophy of science ought to be their applicability to areas which are more representative of the scientific enterprise. Life science is cited as just such an area. It is quantum physics, rather than biology, which nurtures anti-realism. The most respected anti-realism today is that provided by Bas C van Fraassen; and the persuasiveness of his "Constructive Empiricism" (...) is attested to by the failure of avowed realists, such as Ian Hacking, to distance themselves very far from van Fraassen's ideas. A detailed critique of van Fraassen is presented with particular attention paid to his ideas on scientific explanation - the question of whether good explanations are true explanations being one which tends to divide realist and anti-realist. The conclusion is reached that, while realism raises - and fails to answer - a number of philosophical questions, the anti-realism provided by Bas van Fraassen is no better at answering those questions. Moreover, it is argued, van Fraassen's ideas lack plausibility as a description of science and the attitudes of scientists - particularly when attention is shifted from physics to biology. Finally, a number of suggestions are made as to how the philosophical questions posed by realism might be answered in the future. (shrink)

We give a model-theoretic account for several results regarding sequences of random variables appearing in Berkes and Rosenthal [12]. In order to do this,•We study and compare three notions of convergence of types in a stable theory: logic convergence, i.e., formula by formula, metric convergence (both already well studied) and convergence of canonical bases. In particular, we characterise א0-categorical stable theories in which the last two agree.•We characterise sequences that admit almost indiscernible sub-sequences.•We apply these tools to the theory of (...) atomless random variables (ARV). We characterise types and notions of convergence of types as conditional distributions and weak/strong convergence thereof, and obtain, among other things, the Main Theorem of Berkes and Rosenthal. We report on our experiences in a participatory design project to develop ICTs in a hospital ward working with deliberate self-harm patients. This project involves the creation and constant re-creation of socio-technical ensembles that satisfy the various, changing and often contradictory and conflicting needs in this context. Such systems are shaped in locally meaningful ways but nevertheless reach beyond their immediate context to gain wider importance and to be integrated with the larger environment.

Text visualization is the technique of using graphs and charts to examine text as data. Often, these do not represent a text directly and instead display an output based on word counts, word sequences, and so on. This technique can provide insights into important keywords in a text, provide an overview of textual content, or reveal trends and patterns within one text or across many texts. This paper describes recent development of and experiments with several tools for the Grub Street (...) Project to generate visualizations of eighteenth-century texts, especially in terms of the spatial relationships of words and entities on the pages of the original documents. Two examples are discussed in this article as test cases: Edward Ward’s The London Spy Compleat, in Eighteen Parts (1703) and Alexander Pope’s The Dunciad. With Notes Variorum (1729). (shrink)

The aim of this investigation is to discuss the merits of the three radically divergent views as to the nature and function of the categories held by Kant, Ward and Alexander.

Very few writers have had such an impact on their culture as Alexander Solzhenitsyn on Soviet society in the ‘60s and ‘70s Recently published documents from the KGB archives show the problem he posed to the Soviet leadership—not because he was the only one to point out the massive falsehood and injustice of Soviet society but primarily due to the scathing power of his artistic diagnosis. Many of Solzhenitsyn’s writings in fictional, autobiographical, and publicistic genres can helpfully be understood (...) in terms of Plato’s struggle in the Athens of his day for a “remembering” or anamnesis of what it is to be a human being, a human society, and the cosmos as transparent for divinity. That struggle, even though Plato doesn’t use the word “amnesia”, was against the refusal to remember. The Austrian writer Heimito von Doderer called that refusal the Apperzeptionsverweigerung or refusal to perceive. Here we’ll explore Solzhenitsyn’s work in terms of his struggle to remember over against the ideological “refusal to perceive” in the three fundamental dimensions of personal, social and historical existence. Solzhenitsyn expands Mikhail Bakhtin’s understanding of “polyphonic” characterization as a key technique for articulating his diagnosis of Soviet totalitarianism. The discussion will instantiate what can be seen as his understanding of personal amnesia and anamnesis in Cancer Ward, his exploration of social amnesia and anamnesis in In the First Circle, and his treatment of historical amnesia and anamnesis in The Red Wheel and The Gulag Archipelago. The term “know” is one of the ten most common verbs in English, and yet a central aspect of its usage remains mysterious. Our willingness to ascribe knowledge depends not just on epistemic factors such as the quality of our evidence. It also depends on seemingly non-epistemic factors. For instance, we become less inclined to ascribe knowledge when it’s important to be right, or once our attention is drawn to possible sources of error. Accounts of this phenomenon proliferate, but no (...) consensus has been achieved, decades of research notwithstanding. Alexander Dinges offers a fresh examination of this ongoing debate. After reviewing and complementing relevant data from both armchair and experimental philosophy, he assesses extant accounts of this data including semantic, metaphysical, pragmatic, doxastic as well as more recent psychological accounts. Against this background, he offers a novel psychological account based on the idea that non-epistemic factors affect estimates of probability. (shrink)

Understanding how scientific activities use naming stories to achieve disciplinary status is important not only for insight into the past, but for evaluating current claims that new disciplines are emerging. In order to gain a historical understanding of how new disciplines develop in relation to these baptismal narratives, we compare two recently formed disciplines, systems biology and genomics, with two earlier related life sciences, genetics and molecular biology. These four disciplines span the twentieth century, a period in which the processes (...) of disciplinary demarcation fundamentally changed from those characteristic of the nineteenth century. We outline how the establishment of each discipline relies upon an interplay of factors that include paradigmatic achievements, technological innovation, and social formations. Our focus, however, is the baptism stories that give the new discipline a founding narrative and articulate core problems, general approaches and constitutive methods. The highly plastic process of achieving disciplinary identity is further marked by the openness of disciplinary definition, tension between technological possibilities and the ways in which scientific issues are conceived and approached, synthesis of reductive and integrative strategies, and complex social interactions. The importance – albeit highly variable – of naming stories in these four cases indicates the scope for future studies that focus on failed disciplines or competing names. Further attention to disciplinary histories could, we suggest, give us richer insight into scientific development. (shrink)

Scottish philosophy of the seventeenth century was an important part of a wider European philosophical discourse. After situating such thought in its political and religious contexts, the contributors to this volume investigate the writings of a variety of Scottish thinkers in the areas of logic, metaphysics, politics, ethics, law, and religion.

Several current theories have essences as primary drivers of inductive potential: e.g., people infer dogs share properties because they share essences. We investigated the possibility that people take occupational roles as having robust inductive potential because of a different source: their position in stable social institutions. In Studies 1–4, participants learned a novel property about a target, and then decided whether two new individuals had the property (one with the same occupation, one without). Participants used occupational roles to robustly generalize (...) rights and obligations, functional behaviors, personality traits, and skills. In Studies 5–6, we contrasted occupational roles (via label) with race/gender (via visual face cues). Participants reliably favored occupational roles over race/gender for generalizing rights and obligations, functional behaviors, personality traits, and skills (they favored race/gender for inferring leisure behaviors and physiological properties). Occupational roles supported inferences to the same extent as animal categories (Studies 4 and 6). In Study 7, we examined why members of occupational roles share properties. Participants did not attribute the inductive potential of occupational roles to essences, they attributed it to social institutions. In combination, these seven studies demonstrate that any theory of inductive potential must pluralistically allow for both essences and social institutions to form the basis of inductive potential. A popular argument for a right to ectogenic abortions appeals to a right to avoid the obligations associated with parenthood. A common objection to this argument questions whether there are any sufficiently great harms associated with parenthood to ground such a right. I propose a novel formulation of this argument that avoids these objections. I then defend it against important objections.

This book reconstructs James's overlooked political thought by treating his anti-imperialist Nachlass -- his speeches, essays, notes, and correspondence on the United States' annexation of the Philippines -- as the key to unlocking the political significance of his celebrated writings on psychology, religion, and philosophy. Livingston explores the persistence of political questions in James's major works, from his writings on the self in The Principles of Psychology to the method of Pragmatism, the study of faith and conversion in The Varieties of Religious Experience, and the metaphysical inquiries in A Pluralistic Universe. Against the conventional view of James as a thinker who remained silent on questions of politics, this book places him in dialogue with a transatlantic critique of modernity, as well as with champions and critics of American imperialism, from Theodore Roosevelt to W. E. B. Du Bois, in order to excavate James's anarchistic political vision. Bringing the history of political thought into conversation with contemporary debates in political theory, Damn Great Empires! offers a fresh and original reexamination of the political consequences of pragmatism as a public philosophy. Scientific hedges are communicative devices used to qualify and weaken scientific claims. Gregor Betz has argued—unconvincingly, we think—that hedging can rescue the value-free ideal for science. Nevertheless, Betz is onto something when he suggests there are political principles that recommend scientists hedge public-facing claims. In this article, we recast this suggestion using the notion of public justification. We formulate and reject a Rawlsian argument that locates the justification for hedging in its ability to forge consensus. On our alternative proposal, hedging (...) is often justified because it renders scientific claims as publicly accessible reasons. (shrink)

Clinical psychology is characterized by persistent disagreement about fundamental aspects of the discipline ranging from what mental disorders are to what constitutes effective treatment. Attempts to address the problem of epistemic disagreement have been frequently based on establishing the correct answer by fiat without identifying and addressing the sources of the disagreement. We argue that this strategy has not worked very well and the result is frequently ongoing and intractable disagreement, with each side in an argument convinced they are correct. (...) In this paper, we outline an epistemic disagreement procedural model intended to assist researchers and clinicians in the field of clinical psychology to identify, explore, and develop inquiry strategies that capitalize on situations where competing knowledge claims are made. The result is a flexible conceptual framework committed to a defensible epistemic pluralism, fallibilism, and contextualism, across the various research tasks constituting the field of clinical psychology. Gerard of Abbeville's inception speech, which he delivered during the 1250s as a graduating master in theology at the University of Paris, stands out among the extant principia. While many thirteenth-century inception speeches drew clear distinctions between philosophy and theology, and metaphysics and revealed theology in particular, Gerard - who was the foremost secular master of his day - adopted a different strategy in order to establish the preeminence of theology with regard to all other sciences. Consciously avoiding to pit (...) theology against philosophy, he proposed to redefine the relations between both within the conceptual frame of sapiential knowledge. The article analyses how Gerard argues in favor of a supreme wisdom, capable of accommodating Aristotle's first philosophy and Christian theology. Showing that Gerard's approach did not remain uncontested, it traces the remarkable influence of his principium. (shrink)

Casini, Illari, Russo, and Williamson (2011) suggest to model mechanisms by means of recursive Bayesian networks (RBNs) and Clarke, Leuridan, and Williamson (2014) extend their modelling approach to mechanisms featuring causal feedback. One of the main selling points of the RBN approach should be that it provides answers to questions concerning manipulation and control. In this paper I demonstrate that the method to compute the effects of interventions the authors mentioned endorse leads to absurd results under the additional assumption of (...) faithfulness, which can be expected to hold for many RBN models of mechanisms. It is an old idea, lately out of fashion but now experiencing a revival, that quantum mechanics may best be understood, not as a physical theory with a problematic probabilistic interpretation, but as something closer to a probability calculus per se. However, from this angle, the rather special C *-algebraic apparatus of quantum probability theory stands in need of further motivation. One would like to find additional principles, having clear physical and/or probabilistic content, on the basis of which this apparatus (...) can be reconstructed. In this paper, I explore one route to such a derivation of finite-dimensional quantum mechanics, by means of a set of strong, but probabilistically intelligible, axioms. Stated very informally, these require that systems appear completely classical as restricted to a single measurement, that different measurements, and likewise different pure states, be equivalent (up to the action of a compact group of symmetries), and that every state be the marginal of a bipartite non-signaling state perfectly correlating two measurements. This much yields a mathematical representation of (basic, discrete) measurements as orthonormal subsets of, and states, by vectors in, an ordered real Hilbert space – in the quantum case, the space of Hermitian operators, with its usual tracial inner product. One final postulate (a simple minimization principle, still in need of a clear interpretation) forces the positive cone of this space to be homogeneous and self-dual and hence, to be the state space of a formally real Jordan algebra. From here, the route to the standard framework of finite-dimensional quantum mechanics is quite short. (shrink)

Contemporary architecture is increasingly grounded in science and mathematics. Architectural discourse has shifted radically from the sometimes disorienting Derridean deconstruction, to engaging scientific terms such as fractals, chaos, complexity, nonlinearity, and evolving systems. That's where the architectural action is -- at least for cutting-edge architects and thinkers -- and every practicing architect and student needs to become conversant with these terms and know what they mean. Unfortunately, the vast majority of architecture faculty are unprepared to explain them to students, not (...) having had a scientific education themselves. Here is an architecture book by an architect/scientist, just in time to help architects in the new millennium. Alexander discusses many of the scientific terms arising in cutting-edge architecture, and explains them to those who don't have scientific training or advanced mathematical knowledge. We find discussions of the evolution of forms; the importance of process in design; iteration; genetic algorithms; sequences of transformations; different levels of scale (i.e. fractals); etc. They are explained here by an architect who is also a scientist, because he wants to change the way architects think and build. Alexander is not merely popularizing other scientists' results and making them accessible to architects: he is in fact presenting new and original scientific work that ties many of these concepts together in a way that will be useful to architects. The first complete posthumous reflection on the work of Richard Rorty, one of the most important and influential American philosophers of recent times.

A popular way to try to justify holding defendants criminally responsible for inadvertent negligence is via an indirect or ‘tracing’ approach, i.e. an approach which traces the inadvertence back to prior culpable action. I argue that this indirect approach to criminal negligence fails because it can’t account for a key feature of how criminal negligence should be (and sometimes is) assessed. Specifically, it can’t account for why, when considering whether a defendant is negligent, what counts as a risk should be (...) assessed relative to the defendant’s evidence. (shrink)

Georg Lukac's most recent work of literary criticism, on the Nobel Prize winner Alexander Solzhenitsyn, hails the Russian author as a major force in redirecting socialist realism toward the level it once occupied in the 1920s when Soviet writers portrayed the turbulent transition to socialist society.In the first essay Lukacs compares the novella One Day in the Life of Ivan Denisovich to short pieces by "bourgeois" writers Conrad and Hemingway and explains the nature of Solzhenitsyn's criticism of the Stalinist (...) period implied in the situation, characters, and their interaction. He also briefly describes Matriona's House, An Incident at the Kretchetovka Station, and For the Good of the Cause -- stories that depict various aspects of life in Stalinist Russia.In the second, longer section, Lukacs greets Solzhenitsyn's novels The First Circle and Cancer Ward, which were published outside Russia, as representing "a new high point in contemporary world literature." These books mark Solzhenitsyn as heir to the best tendencies in postrevolutionary socialist realism and to the literary tradition of Tolstoy and Dostoevsky. Moreover, from the point of view of the development of the novel, Lukacs finds the Russian author to be a successful exponent of innovative methods originating in Thomas Mann's The Magic Mountain.The central problem of contemporary socialist realism is a predominant theme in the book: how to come to critical terms with the legacy of Stalin. The enthusiasm with which Lukacs acclaims Solzhenitsyn will not surprise those who have followed his persistent refusal to endorse the so-called socialist realist writers of the Stalinist era. He outlines the aspects of Solzhenitsyn's creative method that allows him to cross the ideological boudaries of the Stalinist tradition, yet he finds a basic pessimism in Solzhenitsyn's work that makes him a "plebeian" rather than a socialist writer.Of Ivan Denisovich and the future of socialist realist literature, Lukacs urges: "If socialist writers were to reflect upon their task, if they were again to feel an artistic responsibiliity towards the great problems of the present, powerful forces could be unleashed leading in the direction of relevant socialist literature. In this process of transformation and renewal, which signifies an abrupt departure from the socialist realism of the Stalin era, the role of landmark on the road to the future falls to Solzhenitsyn's story.". In a recent article in this journal, Parker Crutchfield argues that if moral bioenhancement ought to be compulsory, as some authors claim, then it ought to be covert, i.e., performed without the knowledge of the population that is being morally enhanced. Crutchfield argues that since the aim of compulsory moral bioenhancement is to prevent ultimate harm to the population, compulsory moral bioenhancement is best categorized as a public health issue, and should therefore be governed by the norms and values that (...) apply in public health settings. In this article, I argue for two related claims. First, I question the extent to which compulsory moral enhancement should be considered a public health issue that ought to be governed by the norms and values that apply in public health settings. Second, I argue that Crutchfield's argument that covert moral bioenhancement would better respect people's autonomy than an overt program overlooks two important autonomy‐based reasons that, in fact, favor an overt moral enhancement program over a covert one. Alexander's views on universals are, it seems, quite important in the history of western philosophy. When Boethius gives in his second commentary on Porphyry's Isagoge his solution to the problem of universals as he conceived it, he claims to be adopting Alexander's approach. If true, this means that the locus classicus for all western medieval thinkers on this topic is really a rendering of Alexander's teaching. Alexander commented Aristotle’s statement in his On the Soul “The universal (...) animal either is nothing at all or is posterior if it exists”, and this commentary has been translated into Arabic several times in the classical period. In this study the anonymous Arabic translations of Alexander’s commentary has been translated into English. (shrink)
